Plain terms. No surprises.

We wrote these in plain English. Your rights under Australian Consumer Law are always protected and nothing here takes them away.

The short version: month-to-month plans, no exit fees, and your rights under Australian Consumer Law always come first.

1. Agreement to these terms

By activating a RedSpeed service, creating an account, or using our website, you agree to these Terms of Service. If you do not agree, do not use our services.

These terms form a binding agreement between you and RedSpeed Technologies Pty Ltd (ABN 59 695 633 302) ("RedSpeed", "we", "us"). They apply alongside any plan-specific terms, the Critical Information Summary for your plan, and our Privacy Policy.

2. Our services

RedSpeed provides mobile telecommunications and NBN broadband services to residential and small business customers in Australia. Services are subject to network availability and coverage in your area.

  • ·Mobile: voice, SMS, and data on the national 5G and 4G network. Coverage maps are indicative and not a guarantee of service at any specific location.
  • ·NBN broadband: home internet delivered over the national broadband network. Speeds are "typical evening speeds" as defined by the ACCC and are not guaranteed at all times.
  • ·Mokles (coming soon): home robotics products governed by separate product terms at point of purchase.

3. Eligibility and your account

To use our services you must be at least 18 years old, an Australian resident, and provide accurate identity and contact information. Identity verification is required under Australian telecommunications law.

You are responsible for all activity on your account. Keep your login credentials secure and notify us immediately at hello@redspeed.com.au if you suspect unauthorised access.

4. Pricing and billing

Plans are billed monthly in advance. Your billing date is set when your service activates and recurs on the same date each month.

  • ·All prices are in Australian dollars and include GST.
  • ·Your plan price is shown in your Critical Information Summary and account dashboard. We will give you at least 30 days notice before increasing your plan price.
  • ·Payment is processed automatically via the payment method on your account. If a payment fails we will notify you and allow a reasonable time to resolve the issue before suspending your service.
  • ·We do not store full card details. Payment processing is handled by Stripe (PCI-DSS Level 1 certified).
  • ·Unused included data rolls over to the next month ("data bank") on eligible plans. Rollover data expires at the end of that next month.

5. Acceptable use

You must use RedSpeed services lawfully and in a way that does not harm our network, other customers, or third parties. You must not:

  • ·Use services to transmit unlawful, abusive, threatening, or fraudulent content.
  • ·Resell or on-supply RedSpeed services without our written permission.
  • ·Use automated systems to generate excessive traffic that degrades the network for others.
  • ·Attempt to bypass, tamper with, or reverse-engineer any part of our network or systems.

We may suspend or terminate your service without notice if we reasonably believe your use is unlawful or causes harm to our network or others.

6. Service availability

We aim to provide reliable services but we do not guarantee uninterrupted, fault-free access. Services may be affected by planned maintenance (of which we will give reasonable notice), network faults, natural events, and third-party infrastructure (including the NBN Co network and our mobile wholesale partners).

If your service is interrupted for a sustained period and we are at fault, you may be eligible for a service credit. Contact us at hello@redspeed.com.au and we will assess your situation fairly.

7. Your Australian Consumer Law rights

Our services come with consumer guarantees under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded, restricted, or modified. Nothing in these terms limits any right you have under Australian Consumer Law.

If a service fails to meet a consumer guarantee, you are entitled to a remedy. For a major failure, you may cancel your service and receive a refund for any unused prepaid period, or choose a replacement service. For a minor failure, we are entitled to fix the problem within a reasonable time.

8. Limitation of liability

To the maximum extent permitted by Australian law (and subject to your Australian Consumer Law rights), our total liability to you for any claim arising from or connected to your use of our services is limited to the amount you paid us in the three months preceding the event giving rise to the claim.

We are not liable for indirect or consequential losses including loss of data, loss of income, or loss of business opportunity, except where required by law.

9. Cancellation and termination

There are no lock-in contracts. You can cancel at any time through your account dashboard or by contacting us. Cancellations take effect at the end of your current billing period. No exit fees apply.

We may suspend or terminate your service if you breach these terms, fail to pay after reasonable notice, or engage in conduct that is unlawful or harmful. We will give you notice except where immediate action is required to protect the network or other customers.

On termination, any unused credit on your account will be refunded to your original payment method within 14 days.

10. Complaints and disputes

If you have a complaint, contact us first at hello@redspeed.com.au. We will acknowledge your complaint within 2 business days and work to resolve it within 15 business days.

If we cannot resolve your complaint to your satisfaction, you may escalate to the Telecommunications Industry Ombudsman (TIO), which provides free, independent dispute resolution for telecommunications customers in Australia:

11. Changes to these terms

We may update these terms from time to time. If we make a material change we will notify you by email at least 30 days before the change takes effect. Your continued use of our services after the effective date means you accept the updated terms.

If you do not accept a material change, you may cancel your service before the change takes effect without penalty.

12. Governing law

These terms are governed by the laws of New South Wales, Australia. Any disputes that cannot be resolved through our complaints process or the TIO are subject to the exclusive jurisdiction of the courts of New South Wales.
